$3 MILLION SOUTH FLORIDA SETTLEMENT WON ON OBSCURE LAW
Attorneys obtained a multimillion-dollar settlement won on obscure law for the estate of Sophia Gutierrez, a seven-year-old who was hit by a vehicle when she was leaving her elementary school.
“This was the first known case to successfully use the Ramon Turnquest School Crossing Guard Act since it was passed in 1992,” their attorney said.
Section 2. Section 234.302, Florida Statutes, is created to read (in part):
234.302 School crossing guards.—Each local governmental entity administering a school crossing guard program shall provide a training program for school crossing guards according to uniform guidelines for the training of school crossing guards adopted by the Department of Transportation.
“The act requires the Florida Department of Transportation to adopt uniform guidelines and the training of school crossing guards.”
In January 2022 as she attempted to cross a busy intersection, Gutierrez was struck. Defendants, Kemp Group International Corp., were supposed to have three crossing guards positioned, However, there were only two crossing guards and they improperly allowed Gutierrez, her sister, and her parents to pass through the intersection. At the time, a Hyundai Tucson was being driven erratically and off the road while approaching the intersection, court records show.
