Misdemeanor Diversion ProgramCompleting a Misdemeanor Intervention Program may enable defendants to have certain criminal charges dropped in Tampa

The Misdemeanor Intervention Program (MIP) is available in some circumstances to those charged with certain misdemeanors in Hillsborough, Pinellas and most other counties in the Tampa Bay area and the rest of Florida.

Also known as a Misdemeanor Diversion Program, or M.D.P., this type of program affords first time offenders an opportunity to immediately accept responsibility for their actions, seek rehabilitation, and divert their cases from the criminal court system.

With the assistance of an attorney, it may be possible to convince the prosecutor to let a defendant’s case go into this program.

Our law firm has helped 100’s of defendants get into and complete this program to get their charges dropped in Tampa, Hillsborough and Pinellas County.

Is the Misdemeanor Intervention Program the right choice for your situation?

For first time offenders in Hillsborough County there are basically 3 options.

  1. If you’re not guilty, plead not guilty and fight the case on the merits without using a Misdemeanor Intervention Program. This preserves your chance at MIP if anything else happens down the road.
  2. Plead no contest, pay court costs, possibly probation, and wind up with a charge on your record.
  3. Do MIP, stay out of trouble, pay some fees and the charge gets dropped.

A misdemeanor intervention program (MIP) can offer several advantages for participants, the legal system, and the community:

1. Diversion from Criminal Record

  • Participants can avoid a permanent criminal record if they successfully complete the program, which can help with future employment and housing opportunities.

2. Focus on Rehabilitation

  • MIPs often emphasize rehabilitation rather than punishment, providing education and resources to address underlying issues, such as substance abuse or mental health.

3. Reduced Sentences

  • Successful completion of an MIP can lead to reduced or dismissed charges, minimizing legal consequences and potential jail time.

4. Cost Savings

  • Both participants and the legal system can save money. Participants often face lower legal fees and costs associated with court proceedings, while the system reduces the expenses related to incarceration.

5. Support Services

  • Programs typically provide access to counseling, job training, or educational resources, helping participants reintegrate into society successfully.

6. Lower Recidivism Rates

  • MIPs can lead to lower rates of reoffending by addressing the root causes of criminal behavior, promoting positive lifestyle changes.

7. Community Engagement

  • Participants may engage in community service, fostering a sense of responsibility and connection to their community.

8. Judicial Efficiency

  • By diverting minor cases from the traditional court system, MIPs can reduce congestion in courts, allowing them to focus on more serious cases.

9. Personal Accountability

  • Participants are often required to take responsibility for their actions, fostering personal growth and accountability.

10. Positive Outcomes for Victims

  • In cases involving victims, MIPs may promote restorative justice approaches, allowing for dialogue and resolution that benefits both parties.

A misdemeanor intervention program can provide a constructive alternative to traditional prosecution, benefiting individuals and society as a whole.
