Some of our recent Personal Injury Settlements
Fernandez Law Group recovered $4.8 million for minor children who were sexually abused after being negligently placed in the custody of adults with a verified history of sexual abuse. Eckerd Youth Alternatives, Inc. and The Devereux Foundation, Inc. – who contract to provide foster care and related services on behalf of the Florida Department of Children and Families – agreed to the settlement after 3 years of litigation. Through extensive litigation, the law firm’s lawyers uncovered facts which it felt established multiple and egregious failures on the part of the defendants leading directly to physical, sexual, and mental abuse. Among those failures were blatant misrepresentations to a Court, ignoring prior acts of sexual abuse, failure to properly monitor the case file, and the failure to review and interpret background checks. In 2018, lawyers for Fernandez Law Group successfully argued to the Court that there should be no cap on the compensatory damages which the minor children could potentially recover from a jury. The case settled in 2019.
While at an apartment complex, our client leaned against a balcony railing which broke loose and gave way. As a result, our client suffered injuries in a three story fall which included multiple fractures and surgeries. After conducting an extensive investigation, we determined that the apartment complex had been notified of issues regarding the balcony railings on numerous occasions. We located former employees of the apartment complex who were able to confirm that the complex knew about the issues prior to the accident but had failed to make the proper repairs to the railings.
One of our clients sustained injuries to her neck, shoulder and lower back as a result of an automobile accident. Our client had a policy that provided benefits of $100,000 above the insurance policy of the individual who caused the accident. The individual who caused the accident had a $100,000 insurance policy. A jury awarded our client an amount in excess of the two insurance policy limits at trial and total recovery for the client was $1.1 million. The award was based on the insurance company’s failure to timely pay the claim, which forced our client to file a lawsuit in which a Bad Faith settlement was obtained.
While driving on the Florida Turnpike, one of our clients was involved in a rear-end collision caused by a negligent tractor trailer driver. The accident was clearly the fault of the truck driver, however, the driver and his insurance company attempted to blame our client instead. The insurance company was attempting to use a “sudden stop” defense with the help of their accident reconstruction experts. Their goal was pass the blame to our client by creating a different scenario as to how the accident could have happened. In addition, our client was also examined by the insurance company doctors who attempted to allege that the serious injuries sustained by our client were not related to the accident. Insurance companies use these tactics often, but our client’s back and knee surgeries were directly caused by the accident. In an effort to cause further frustration to our client, the insurance company and their attorneys continually delayed the case. We stepped in and successfully litigated the case, and reached a settlement result and resolution on the first day of trial.
A motorcycle malfunctioned resulting in a single-vehicle accident that caused several injuries to our client’s knee which required multiple surgeries and prohibited him from ever returning to work. The case became rather complex and required years of investigation but we were able to find similar accidents that had occurred. As a result, we were able to prove the manufacturer had knowledge of the issues with their motorcycles throughout the United States as well as in Europe.
Our client was on vacation in Naples, Florida. While walking through a resort, he slipped and fell on a sidewalk that had been improperly painted and sealed by the resort. The painted and sealed sidewalk was extremely slippery when it became wet. This was due to the resort’s failure to have the required slip-resistant material mixed into the paint. Our client sustained an injury to his knee and his left wrist. After undergoing three surgeries, he was limited in his ability to properly use his left knee and left wrist. Extensive depositions and investigations concluded that the hotel was aware of this situation, lied about their knowledge and attempted to hide the truth.
After a seven-car multi-vehicle accident pileup on the Florida Turnpike, our client sustained various injuries, including a close-head injury and internal bleeding. The individual who rear-ended our client tried to blame several other people involved in the accident. The case was resolved in our client’s favor after the hiring of multiple experts, an intensive investigation and working with various accident reconstruction experts.
